South Korea AI Basic Act Statement
This Statement sets out the position of Prodia Systems Ltd ("Prodia") in relation to the Republic of Korea's Act on the Development of Artificial Intelligence and Establishment of Trust (the "AI Basic Act"), which entered into force in 2026, and the implementing rules issued by the Ministry of Science and ICT (MSIT). It is governed by the laws of Ireland but is provided to support customers and users in the Republic of Korea.
1. Scope
Where the prodia.dev Service is made available to users in the Republic of Korea, Prodia acts as an AI business operator within the meaning of the AI Basic Act. Customers acting as deployers in Korea are responsible for their own obligations under the Act in respect of their downstream use of the Service.
2. High-Impact AI
The Service is, in its standard configuration, not provided as a "high-impact AI" system within the meaning of Article 2 of the AI Basic Act. Where a customer configures the Service in a manner that brings their use within the scope of high-impact AI, the customer is responsible for the corresponding obligations, including risk management, human oversight and user notification.
3. Transparency & Labelling
- Users are clearly informed that they are interacting with an AI system.
- Output generated or substantially modified by the Service is identifiable as artificially generated, consistent with Korean labelling requirements for AI-generated content.
- Customers using the Service to produce content for the Korean public are responsible for any further notice or labelling obligations applicable to them.
4. Human Oversight & Risk Management
The Service is designed so that natural persons can effectively oversee its operation. Customers control oversight levels, approval gates and execution scopes, and can suspend or roll back agent actions. Prodia maintains a risk-management process aligned with the AI Basic Act and international standards including ISO/IEC 42001 and the NIST AI RMF.
5. Generative AI & Foundation Models
Where the Service incorporates generative AI or foundation models supplied by third parties, Prodia selects providers that publish information sufficient to meet applicable Korean transparency obligations.
6. Cooperation with Authorities
Prodia will cooperate, in good faith and within the limits of applicable law, with MSIT and other competent Korean authorities, including by providing documentation and information lawfully requested.
