China AI Regulations Statement
This Statement sets out the position of Prodia Systems Ltd ("Prodia") in relation to the operational AI regulatory regime of the People's Republic of China, including the Interim Measures for the Management of Generative Artificial Intelligence Services (2023), the Provisions on the Administration of Deep Synthesis Internet Information Services (2023) and the Provisions on the Administration of Algorithmic Recommendations for Internet Information Services (2022).
1. Service Availability
Prodia does not target the prodia.dev Service at users located in mainland China and does not represent that the Service complies with all licensing, registration, filing and security-review requirements imposed by Chinese law on services made available to the Chinese public.
2. Content Labelling
Where the Service is used in connection with content distributed in China, output generated or substantially modified by the Service is identifiable as artificially generated, consistent with the labelling principles of the Deep Synthesis Provisions and the Generative AI Measures.
3. Customer Responsibilities
- Determining whether their use of the Service requires algorithm filing, security assessment or other approvals from the Cyberspace Administration of China (CAC) or other competent authorities.
- Implementing user identity verification, content moderation and reporting mechanisms as required by applicable Chinese law.
- Ensuring lawful cross-border transfer of personal information and important data under the Personal Information Protection Law (PIPL), the Data Security Law and the Cybersecurity Law.
- Not using the Service to generate content prohibited by Chinese law.
4. No Local Establishment
Prodia has no establishment in mainland China. References to Chinese regulations in this Statement are provided for transparency and do not constitute submission to the jurisdiction of Chinese authorities save to the extent required by mandatory provisions of law.
