India AI Governance Statement
This Statement sets out the position of Prodia Systems Ltd ("Prodia") in relation to India's evolving AI governance regime, including advisories issued by the Ministry of Electronics and Information Technology (MeitY), the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the framework established under the Information Technology Act, 2000.
1. Governance Principles
- Reliability and safety of AI systems, consistent with NITI Aayog principles for Responsible AI.
- Transparency, including labelling of AI-generated content where required.
- Accountability and human oversight.
- Non-discrimination and inclusivity.
- Privacy and security by design.
2. Data Protection
Personal data of data principals in India is processed in accordance with the DPDP Act and rules made thereunder. Customers act as Data Fiduciaries and Prodia as Data Processor within the meaning of Section 2 of the DPDP Act.
3. Intermediary & Content Obligations
Customers using the Service in connection with intermediary platforms in India are responsible for compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including any labelling and due-diligence obligations applicable to synthetically generated content.
4. Future Legislation
Prodia will update this Statement to reflect the proposed Digital India Act and any India-specific AI legislation when adopted.
